AP LEAVE Rules



n     FR 11 Every Govt. employee is whole time employee of the Govt.
n     Leave is a permission granted to a Government servant to be absent from actual duty
n     FR 18: willful absence to duty – to be treated as dies-on. 
n     FR 67 – leave cannot be claimed as a matter of right. When the exigencies of the public service so require, discretion to refuse or revoke leave of any description is reserved with the sanctioning authority
A temporary Govt.servant working under emergency provisions, who remains absent from duty after applying for leave or extension of leave to which he is not entitled to under the rules, shall be deemed to have been discharged from duty with effect from the date from which he is not entitled to any leave unless the leave applied for is granted by Govt. in relaxation of relevent rules – Rule 6 A


n     Rule 6 – any kind of leave admissible may be granted in continuation with any other kind of leave (other than casual leave) so admissible or in continuation of leave already taken whether of the same or any other kind
n     FR 66 – authorities competent to sanction leave other than special disability leave
n     Vacation may be availed in combination or in continuation of any other kind of leave.
n     Fr 68: The type of leave requested by the individual only to be sanctioned and no discretionary powers shall be exercised by the authorities
1.  ADVANCE CREDIT

Credit of EL for temporary employees, if joined after first of the month
If Government Servants is appointed on or after 1st of a month or during the middle of a month, it  should be ignored and advance credit  be given on the basis of number of completed months in that half year as follows:

Credit of EL for regular employees, if joined after lst of the month
n     If a Government Servant is appointed regularly, the month in which  he has been appointed should be ignored if it is after 1st, and for the number of completed months in that half year, advance credit should be given at the rate of 2 1/2 days for each month in that half year.  The credit to be given should be rounded to nearest day .0.5 should be taken as one day and less than 0.5  be ignored


n     While giving advance credit,
n     1/10th of EOL so availed in the previous  half year
n     not exceeding the earning capacity i.e. not exceeding 8 days ) should be deducted and the balance only be given as an advance credit


AVAILMENT
  1. CASUAL LEAVE
(1) not more than 10 days continuously including public holidays/optional holidays/compensatory leave    
(2) full salary
  1. OPTIONAL HOLIDAYS
     (1) only on optional holidays declared by Govt
     (2) not more than 10 days continuously including public holidays/casual leave/compensatory leave
    (3) can be clubbed with earned leave/EOL/Leave on Half  pay/ Half pay commuted to full pay
   (4) if rejected on administrative grounds, automatically convert       into a  casual leave– to be availed before end of the calendar year 
   (5) full salary
                                                   

3. EARNED LEAVE
1)     full salary
2)     can be clubbed with public holidays/ compensatory leave/any other leave except casual leave
3)     On 30th June of the year (if Govt. issue orders) can be surrendered the days exceeding 300 days at credit
4)     Can be recasted after declaration of probation, but not to reopen the leave already sanctioned

REGULAR EMPLOYEES
Availment – Not more than 240 days in entire service

20 days for every completed year of services  - in all kinds of leave excluding dies non & Suspension period treated as not on duty for counting in the period of one year (APLR 13&18)

AVAILMENT
  1. COMPENSATORY LEAVE   
(1) not more than 10 days in a year
(2) to be  availed within six months from the date of accrual
(3) can be clubbed with any other kind of leave
(4) FULL SALARY
2. HALF PAY LEAVE :
    (1) half pay + half of DA + half of all allowances/proportionate allowances as the case may be
    (2) can be clubbed with any kind of leave including compensatory leave and optional holidays, but not  with casual leave

3. HALF PAY COMMUTED TO FULL PAY ON MEDICAL GROUNDS : -
(1)Can be clubbed with any kind of leave – including compensatory leave/optional holiday – but not with casual leave
(2) should not exceed 240 days in the entire service
(3) supported by a medical certificate and physical fitness certificate

n     The Government Servant who has not completed probation period can be granted HPL on Medical Grounds  subject to the following condition.
n     1) Superior Service        -       Should have completed 2 years of regular service
n     2) Inferior Service          -       Should have completed 1 year of regular service
